1. Agreement to Terms

These Terms and Conditions (the "Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you (the "User," "Player," "you," or "your") and phnice (the "Company," "we," "us," or "our"), operating the website https://phnice.cam and associated mobile applications (collectively, the "Platform" or "Service"). By accessing, browsing, registering an account, or using any feature of the phnice Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Responsible Gaming Policy, which are incorporated herein by reference.

Attempting to register or use the Service while underage constitutes a material breach of these Terms and may result in criminal prosecution under Philippine law.
• Legal Capacity: You must possess the legal capacity to enter into binding contracts under Philippine law. Individuals who have been declared legally incompetent or are subject to guardianship may not register or use the Service.
• Jurisdictional Compliance: You must be physically located in a jurisdiction where online gambling is legal and you are permitted to participate in such activities. It is your sole responsibility to ensure compliance with local, provincial, and national laws governing online gambling in your jurisdiction.

3. Account Registration and Security

3.1 Account Creation

You may maintain only one (1) account per person. phnice employs industry-standard security measures including SSL encryption, secure servers, and regular security audits to protect user accounts. However, we cannot guarantee absolute security. You acknowledge that transmitting information over the internet inherently carries security risks and agree to hold phnice harmless for unauthorized access resulting from factors outside our reasonable control.

3.3 Account Verification

phnice reserves the right to verify your identity, age, and other account information at any time using government-issued identification documents such as Philippine national ID, passport, driver's license, or other valid identification accepted under Philippine law. This verification process is mandatory before processing withdrawal requests and may be required at other times to comply with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations under Republic Act No. 10365 (Anti-Money Laundering Act of 2012, as amended).

Verification typically requires submission of clear, legible copies of photo identification showing your full name, photograph, date of birth, and document expiration date, as well as proof of address such as a recent utility bill, bank statement, or government correspondence. All deposits are processed in Philippine Pesos (PHP). Cryptocurrency deposits are converted to PHP at the prevailing exchange rate at the time of transaction. Foreign currency deposits through international payment methods are converted to PHP using the exchange rate provided by the payment processor, which may include conversion fees beyond phnice's control.

4.2 Transaction Processing

Deposit funds are typically credited to your phnice account balance instantly for GCash, PayMaya, and cryptocurrency transactions. Bank transfers may require 15 minutes to 4 hours for processing depending on the bank and transaction volume. phnice does not charge fees for deposits, though your payment provider may impose their own transaction fees.

You warrant that all funds deposited originate from legitimate sources and are not derived from illegal activities. phnice complies with all applicable anti-money laundering regulations and reserves the right to investigate the source of funds, request additional documentation, or refuse suspicious deposits.

4.3 Deposit Limits

As part of our responsible gaming commitment, phnice allows players to set voluntary deposit limits on a daily, weekly, or monthly basis. Once set, deposit limits can only be increased after a cooling-off period of 24 hours, though they can be decreased or removed immediately. 10. Limitation of Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW, PHNICE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

phnice's total liability to you for all claims arising from use of the Service shall not exceed the amount of deposits you made to your account in the six (6) months preceding the event giving rise to liability.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

11. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines without regard to conflict of law principles. Any disputes arising from or relating to these Terms or use of the phnice Platform shall first be submitted to good-faith negotiations between the parties.

If disputes cannot be resolved through negotiation within thirty (30) days, the matter shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). Arbitration shall be conducted in Metro Manila, Philippines, in English language. The arbitrator's decision shall be final and binding on both parties.

Notwithstanding the foregoing, phnice reserves the right to seek injunctive relief in courts of competent jurisdiction to protect intellectual property rights or prevent ongoing Terms violations.

12. Privacy and Data Protection

Your privacy is important to phnice. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which complies with the Data Privacy Act of 2012 (Republic Act No. 10173). By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy.

phnice implements appropriate technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic storage or internet transmission is 100% secure, and we cannot guarantee absolute security.

13. Termination

You may close your phnice account at any time by contacting Customer Support and requesting account closure. Upon closure, you must withdraw all remaining funds from your account balance. Unclaimed balances in closed accounts may be forfeited after twelve (12) months of inactivity.

phnice reserves the right to suspend or terminate your account immediately without prior notice if:

• You breach any provision of these Terms
• We suspect fraudulent, abusive, or illegal activity
• We are required to do so by law or regulatory authority
• Your account remains inactive for 24 consecutive months

Upon termination for Terms violations, all pending bonuses and associated winnings will be forfeited. Deposited funds not involved in fraudulent activity will be returned to you after deduction of any applicable fees or chargebacks.

14. Miscellaneous Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and phnice regarding use of the Platform and supersede all prior agreements, representations, and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14.3 Waiver

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without phnice's prior written consent. phnice may assign these Terms to any affiliate, subsidiary, or successor entity without notice.

14.5 Force Majeure

phnice shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, strikes, telecommunications failures, or internet service disruptions.
